Terms for cafés, restaurants, bars and clubs
Here, “venue” means a café, restaurant, bar or club. These terms cover your venue's use of Some1, including Basic, Pro, prepaid voice credits and optional automatic top-ups. They form the service terms between your business and Sintax Error Private Limited, together with the quote you confirm and our Privacy, Refund and Service delivery policies.
Effective 1 November 2026 · Revision 2026-11-01.5
Optional Fluent voice
Fluent is available to venues with active voice access, subject to Some1 availability controls. Owners may select it directly or as Balanced’s default host outside scheduled Expressive hours. Each visit keeps the host and voice chosen at its first voice connection until the visit closes. Fluent uses that venue’s contracted Everyday credit rate, including conversations without orders; existing credit limits, settlement and refund terms apply. Guests must separately agree to the voice data notice before their microphone starts. The provider account’s API retention period remains unconfirmed, and zero retention is not promised. Voice samples are generated on request and incur supplier cost without debiting guest voice credits. Availability does not guarantee accuracy in every language or uninterrupted service.
Optional owner assistant pilot
Owners of eligible venues on an active paid plan may explicitly activate the read-only dashboard assistant. It is not included in the free plan. It cannot change orders, bills or settings. Optional Call Some1 uses OpenAI GPT-Live with the same read-only owner permissions and the displayed time-based Expressive rate, funded from the shared venue voice balance. It cannot place guest orders. A successful text answer, including optional saved-answer read-aloud without microphone input, costs 1 shared AI credit; a successful microphone transcription costs 1 additional credit, even if its text is not sent. Failed operations release their reservation. The pilot limit is 20 credits per venue per IST day. Owners can turn it off. Questions and limited operational records are processed by OpenAI; important answers should be checked against original records. Owner call text history lasts up to 30 days. Optional private diagnostic audio is initially shown on, requires the displayed call notice before capture, lasts up to 7 days and can be disabled in Settings; existing diagnostic recordings are then queued for deletion. This is troubleshooting and product improvement, not activation of a model-training pipeline. The Privacy & Data Policy describes access, temporary results and usage retention.
Permanent account deletion
Owners can permanently close a venue from Settings → Danger zone after closing visits, settling active usage and resolving payment/refund reviews and automatic top-up cancellation. Confirm the exact venue name, type DELETE, choose a reason and acknowledge the notice. The workspace closes immediately while scoped background cleanup removes its operational content, team access, application and unshared uploads. Guests retain their own personal food preferences and served-meal history; another venue or guest account is not deleted. The owner sign-in remains available for other venues or a fresh application. Deletion cannot restore a closed venue.
Voluntarily deleting a venue permanently ends its Pro access and forfeits remaining included and purchased credits after the explicit deletion acknowledgement. There is no ordinary change-of-mind refund after voluntary deletion; request any unused-credit refund review before deleting. Pro and credits cannot be transferred to another account or venue. This does not limit refunds or remedies required by law. Required invoices, payment/refund/mandate ledgers, consent and deletion evidence, and records needed for disputes remain restricted; provider logs, sent email and backups follow their retention cycles. We do not promise immediate erasure from every provider or backup.
1. Business authority and approval
You must be at least 18 and authorised to act for the applying business. Supply accurate business/contact details and an accurate venue map pin. Verify the owner phone by WhatsApp or SMS. Only supply documents or tax details when requested and when you are entitled to provide them. Business-document upload is temporarily waived for new onboarding; manual approval is still required. Signup is free. A pending application gives access to its status, not permission to operate a live venue; Some1 manually reviews and approves access. Use a separate email for guest participation.
Approval is a platform access decision, not a government licence or certification of food safety. The venue remains responsible for registrations, FSSAI and other licences where applicable, taxes, lawful employment, consumer obligations, food safety and its products. Sensitive venue identity changes require evidence and review.
2. Basic and Pro
Basic provides the available manual ordering and venue workflow features without a setup fee or recurring Basic subscription charge. Pro adds the enabled AI host features and the monthly voice allowance shown in the quote. Access and availability depend on venue approval, active service status and the purchased plan.
Included voice minutes are calculated from the allowance and selected experience rate. Any order-count examples are illustrative, not guaranteed; conversations without orders also consume time. Evidenced charges after voice disconnection receive service credits under the refunds policy.
The current pricing page and payment review show the INR price, billing period, included allowance, applicable tax and discounts. The confirmed quote controls that purchase. Pro is paid in advance monthly or annually. Annual payment buys twelve separate monthly allowances, not an unrestricted annual pool. Plan renewals are manual; a Pro purchase does not by itself authorise a recurring bank debit.
3. How voice allowances and top-ups work
Voice consumes credits according to the selected experience and the displayed credit terms, including conversations that do not produce an order. Approximate orders or cost per successful order are illustrations, not guaranteed capacity, fixed per-order billing or a promise of extra revenue. Longer conversations, the experience mix and abandoned sessions affect usage.
Included credits refresh for each paid monthly period and unused included credits expire at that period's end. Purchased top-ups do not expire, but require active Pro and your permission to use them. Promotional grants follow their stated conditions and are not purchased cash. Credits are a limited right to use Some1 voice service: they cannot be transferred between unrelated venues, spent on venue food, withdrawn as cash or used as a bank deposit. Refund rights are set out separately.
We reserve available credits to fund an active voice session and settle its usage afterwards; unused reserved amounts return to their original source subject to that source's expiry. Usage history identifies included allowance, top-ups and attributed visits/orders. If Pro lapses or funds run out, new voice sessions stop and guests can use the manual menu. Already funded sessions may finish within their authorised allowance.
4. Experience choices and operating controls
Where enabled for your account, Everyday, Expressive and Balanced have different service characteristics and credit consumption. Balanced uses Everyday by default and Expressive during your configured hours. At the first voice connection, it selects one model and voice for the table visit, including reconnects and additional orders, until staff closes that visit. It does not select a model for each question or switch models mid-conversation. An optional owner-set daily Expressive credit threshold makes new Balanced visits start with Everyday after used and reserved Expressive credits reach the threshold. It is not a hard spending cap: existing visits continue with their chosen host and can exceed it. All commercial Expressive calls are counted from the release of this feature, including calls in Expressive mode, against the venue-local calendar day and time zone at call start. Unused holds are released; calls spanning midnight remain on their starting day. Changing time zone uses separate day totals. Available funds and normal service limits still apply. Recent host comparisons use bounded samples of existing usage, order and diagnostic records, include attempts without orders, and do not measure satisfaction or automatically change your schedule. Venue owners choose their available experience. Some1 administrators control availability across the platform or for a venue, rather than choosing on the owner's behalf. Balanced requires both Everyday and Expressive to be available. A paused option is shown as temporarily unavailable; saved preferences are retained, and active conversations retain their existing voice and rate. Available controls, saved experience and the starting session's price rules govern usage.
The owner is responsible for host limits, team access, menu/knowledge accuracy, language and character configuration, and reviewing AI behaviour. AI prepares actions for the application's confirmation flow; it must not be treated as an independent authority on billing, discounts, food safety or order fulfilment.
5. Optional AutoPay and cancellation
Automatic top-ups require an additional, explicit Razorpay mandate and a supported payment method. You choose the threshold, refill amount and monthly cap. Authorisation amount, maximum debit, validity and notices are shown in the mandate flow; never approve an amount you do not recognise.
AutoPay is not instant: provider pre-debit notice and processing delays can mean a top-up takes a day or longer. A threshold is a request trigger, not a promise of uninterrupted voice. Pending or failed debits are not spendable credits. Manual top-ups remain available when checkout is enabled.
You may disable future automatic requests and request mandate cancellation in the dashboard, and use your payment app or bank's cancellation controls. Treat the mandate as cancelled only after confirmation. An already initiated debit may still settle and will be reconciled once; contact support if it needs review. Turning off the AI host, Pro ending or closing the browser does not itself cancel the separate mandate.
6. Venue content, staff and guest data
You retain rights in your menu, logo, authorised audio and business material, and permit Some1 and its service providers to host, process and display it to operate your venue experience. Obtain rights and the speaker's informed permission before uploading reference audio. Do not impersonate a person or submit confidential, infringing or unlawful content.
You control staff access and must remove access when it is no longer required. Handle the customer directory, guest contact details, orders and reports only for legitimate venue service, accounting and support. Directory access is not consent for advertising, selling data or unsolicited messages; obtain any separate consent required by law.
Some1 processes venue-directed operating data to deliver the service and manages account, verification, billing and security data for its own service responsibilities. Both parties must meet the obligations applicable to their role. Cooperate with privacy requests and incident investigations, disclose venue-specific practices to guests and do not obstruct a guest's rights.
7. Discounts, documents and refunds
Coupon eligibility, scope, dates and discount are shown before purchase. Unless an offer says otherwise, launch discounts apply to the initial plan allowance and not subsequent top-ups; an annual first-month offer discounts only its first monthly equivalent. Do not assume an earlier offer applies to a later purchase.
Invoices preserve the verified transaction's billing details and price; refunds may produce a credit note. Provide the correct legal name, address and GSTIN before paying. Price changes apply to new quotes/purchases under their disclosed terms, not silently to an existing paid quote or funded session. Read Refunds & cancellations for unused-credit requests and payment errors.
8. Suspension, changes and legal rights
We may restrict access for material non-payment, misuse, security incidents, unlawful conduct or materially false verification, with notice and an opportunity to address the issue where practicable. We may act immediately where needed to protect users or meet law. Contact support to close the service, export available records or request deletion; lawful financial, dispute and security retention can continue.
We aim to provide a reliable service but do not promise uninterrupted availability, a particular order conversion rate or error-free AI. Notify us of service defects so we can investigate and apply the Refund policy or another legally required remedy. Nothing here removes obligations or liability that cannot be excluded under Indian law.
Indian law governs these terms. Use our published grievance contact for disputes; competent courts, consumer forums and statutory authorities remain available as applicable. Material policy changes require a dated update and appropriate notice or renewed consent. Existing paid transactions remain governed by their confirmed commercial terms.
